My name is Dan Bunch. Recently, I retired after nearly 13 years on the bench in the 13th Judicial District, Klamath County. I continue to serve the OJD as a Senior Judge. I am a Virginian who moved to this great state some 23 years ago. I began my legal career in the US NAVY, serving 4 years as a military attorney (JAG), followed by 4 years in the US Air Force. Upon leaving active duty I served 24 busy years in the reserves. I retired last year as a Major General. My civilian experience also includes 2 years as a prosecutor, 4 years as county counsel of Klamath County, and 7 years in private practice to which I have recently returned.

Mediation is a voluntary, confidential process where a neutral third party (the mediator) helps disputing parties communicate and negotiate to reach a mutually acceptable agreement. Unlike litigation, mediation is collaborative rather than adversarial, allowing parties to maintain control over the outcome.

If mediation doesn't result in a complete agreement, you haven't lost anything. You can still pursue litigation or other dispute resolution methods. Often, even partial agreements reached in mediation can narrow the issues for future proceedings, saving time and money.

Mediation fees vary based on the complexity of the case and number of sessions required. Generally, mediation costs significantly less than litigation.

The mediation process itself is not binding, but any written agreement you reach can become legally binding once signed. In divorce cases, the agreement can be incorporated into your divorce decree, making it enforceable by the court.
